Unfair Competition Settlement

December 2007 – A former manager of a Saddle Brook-based manufacturing company who set up a competing business agrees to a restrictive covenant and the sale of his manufacturing equipment and raw materials inventory as part of the settlement of an unfair competition action brought in the Superior Court of New Jersey, Bergen County.  The action alleged that the former employee had misappropriated proprietary information in establishing the new business to compete with his former employer.  McDaniel Law represented the plaintiff.

Construction Dispute Settlement

November 2007 – The owner of a West Virgina construction company who personally guaranteed payment and performance bonds for a road construction project is released from liability on  claim in excess of $3 million for approximately $100,000, payable over four years in settlement of an action filed in the United States District Court for the Southern District of New York.  The settlement followed a motion to dismiss for lack of jurisdiction.  McDaniel Law represented the defendant.

Securities Litigation Settlement

August 2007 – A New York hedge fund compromises its claim against a West Coast pharmaceutical company in response to counterclaims by the defendant company alleging violations of federal securities laws and short sale regulations.  McDaniel Law is special counsel to Steven Ross, Esq. in preparing the defendants’ counterclaim.

Summary Judgment Grants Permanent Injunction

April 2007 – A property owner is permanently enjoined in the Superior Court of New Jersey, Passaic County, from interfering with the rights of Lakeland Bank to use a billboard located on the site of its former administrative offices.  Judge Margaret McVeigh grants the permanent injunction in response to a motion for summary judgment.  McDaniel Law represented the plaintiff Lakeland Bank.

Distributor Litigation

August 2004 – A Netherlands-based producer agreed to pay damages to a Long Island importer and distributor of independently produced classical music in response to a lawsuit in the United States District Court alleging fraud and misrepresentation in connection with an agreement to import and distribute dvds of opera performances.  McDaniel Law represented the plaintiff.
